At Liight, we appreciate simplicity and clarity. Therefore, with the aim of providing users with the best possible user experience (UX), we have consolidated all our legal documents on a single page.
Throughout this page, you will find our Terms and Conditions (outlining the rights and obligations between Liight and users) and our Privacy Policies (indicating how we store and use your personal data).
*Please be advised that these terms are an automatic translation of the terms in Spanish. In case of any doubts or inconsistencies, the most valid and binding version will be the Spanish version. We appreciate your understanding and recommend referring to the original Spanish version for any clarification.
Terms and Conditions
1. General Conditions
These General Terms of Use govern the use of the Liight software application (hereinafter referred to as the "Application") and the website www.liight.es (hereinafter referred to as the "Website"), whether under its current name or any other name it may adopt in the future. Liight is headquartered at Edificio Lanzadera, La Marina de Valencia, 46024 Valencia, currently legally represented by the Limited Company LIGHT APP S.L. with VAT ID B87864658, reachable through communication channels at hello@liight.es and social media profiles.
These conditions will have an indefinite validity period and will apply to all services provided by Liight through the mentioned channels (hereinafter referred to as the Platform). However, Liight reserves the right to unilaterally modify these conditions for legal reasons, technical reasons, changes in service provision, changes in regulations, or modifications arising from applicable standard codes, or, if necessary, for strategic corporate decisions.
When such changes occur, the new conditions will be published on the website, allowing users to opt-out if they do not agree. If the user continues to use the service, it will be understood that they accept the introduced modifications. The Application is exclusively intended for users residing in the European Union. Users residing elsewhere, choosing to access and/or use this Application, do so at their own responsibility and risk, ensuring compliance with applicable local legislation.
By accessing and using this Application and Website, you ("User") acknowledge that you have read and accepted these General Terms of Use, committing to comply with all its terms and conditions. Additionally, the User acknowledges and accepts that access and use of this Application and/or Website are subject to the General Terms of Use in force at the time of access.
Liight reserves the right to modify these General Terms of Use at any time, as well as any other general or specific conditions that may apply. Users can notify Liight through the Help Center if they do not accept any eventual modifications to these General Terms.
Furthermore, Liight reserves the right to suspend, interrupt, or cease the operation of the Application and/or the Website at any time. Access to certain content and the use of some services, features, or products may be subject to specific conditions, which, as applicable, will replace, supplement, and/or modify these Liight Terms of Use, and in case of contradiction, the terms of the specific conditions will prevail over those stipulated in the Terms of Use.
2. Purpose and Scope of Application
The main objective of the Platform is to initiate and develop Activities and the so-called "challenges," which are events, contests, and/or promotional activities of various kinds (hereinafter referred to as Challenges) organized by Liight, at its sole discretion or proposed by third-party collaborating companies of Liight (Brands and Partners).
In this regard, participation in the potential Challenges offered by Liight implies the acceptance, if applicable, of the specific conditions of each of these Challenges. Generally, participation in Challenges may be subject to additional requirements for participants (age, location, etc.), and the awarding of prizes to winners may be subject to the fulfillment of certain conditions, which will be duly announced.
Activities are actions that users can perform and track through the Liight application, benefiting the sustainability of our cities. Examples include the use of Public Transport, Bicycles, Electric or Shared Mobility, Physical Activity, or Recycling.
The following general conditions will also apply to Challenges offered by Liight through the Platform, unless opposed to the detailed rules applicable in each case:
- Participation in Challenges available through the Platform is personal, and third-party participation is not allowed.
- Individuals under 14 years old cannot participate in Challenges available through the Platform, and those under 16 can only participate with the permission of their parents or legal guardians. However, there may be Challenges for those over 18, which will be duly announced in the specific challenge conditions, preventing registration in a Challenge for a user who has indicated in their profile that they are under 18.
- Participation by legal entities is expressly excluded unless specified otherwise.
- Liight may terminate, extend, or conclude the event, contest, or promotional activity if deemed reasonable or necessary.
The completion of a Challenge by the User will be subject to review by the service administrators to verify its proper completion, compliance with usage conditions, and other requirements. However, upon completing a Challenge, the corresponding points will be directly awarded to the User, as Liight trusts that the User will perform it correctly. Later, Liight will verify if the challenge has been completed correctly and meets the required criteria. If the challenge has been completed incorrectly, Liight has the right to withdraw the points awarded for that challenge.
In the event that Liight detects any anomalies or fraudulent activity or suspects that a participant is trying to disrupt the normal progress of a Challenge, Liight may unilaterally and without prior notice, eliminate the registration of that participant, remove the Challenge, and/or declare it void, without Liight incurring any liability to the participants.
Prizes are personal and non-transferable, categorized into two types:
(i) EXP: Experience points obtained through the completion of activities, challenges, participation in leagues, and the creation-participation in missions, teams, or other internal mechanics. Users, as they interact with Liight, gain more knowledge, reflected in their EXP, allowing them to level up and unlock different functionalities and rewards.
(ii) Liights: Virtual resources obtained through the completion of activities, challenges, participation in leagues, and the creation-participation in missions, teams, or other internal mechanics. Liights are virtual coins redeemable for exclusive challenges or leagues and various actions within the platform. Users can also redeem them for rewards such as merchandise, discount codes, tickets for draws, or various available prizes.
Additionally, prizes consisting of online or offline goods or services may be proposed. These prizes cannot be exchanged for other goods or services or delivered in cash. If necessary, Liight reserves the right to substitute prizes with others of equivalent value. Moreover, if the prize requires shipping, it will be done within the Spanish territory unless specified otherwise.
The Challenge winner receiving a prize will be responsible for applicable taxes and any expenses not detailed in the prize description.
Under no circumstances will Liight be liable for any damages suffered by the winner or third parties regarding the prize or participation in the respective Challenge, except as required by law.
Liight may suspend or cancel any Challenge due to force majeure.
Participation in any of our Challenges implies full acceptance of these general conditions, the Terms of Use, as well as the specific conditions applicable in each case.
In any case, in Challenges available through the Platform organized by proposal of third-party collaborating companies of Liight (Brands and Partners), any claims that may arise must be directed directly against these companies. Liight is not responsible, directly or indirectly, for any failure, error, or, in general, non-compliance by these collaborating companies regarding Challenges available through the Platform and organized by them, with these companies being the sole responsible entities.
3. Content
Through the Application, Liight provides the User with a service of challenges, rewards, and monitoring of carbon footprint reduction by tracking everyday sustainable activities such as the use of public transportation, physical activity, or recycling (hereinafter, the "Service").
The Application and/or Website provide the User with access to various content, information, and data provided by Liight in relation to the Service (hereinafter, the "Content").
Liight reserves the right to modify the presentation, configuration, and location of the Application and/or the Website, as well as the corresponding conditions of access and use, at any time. Liight does not guarantee that the Content provided through the Application and/or Website will always be correct, complete, or up-to-date.
Liight acts as an intermediary on its behalf in providing monitoring and tracking services for sustainable activities and in publishing challenges and rewards in the different feeds of the app. The exclusive responsibility for the provision of services and rewards obtained or contracted through the Application and the Service developed by Liight, both in terms of information regarding schedules, routes, locations, traffic, etc., and in the rewards section, lies with third parties (Brands and Partners).
Liight only provides the User with a tool to track services provided by third-party carriers (e.g., Public Transport) or user movements (Physical Activity, Bicycle use, Electric or Shared Mobility, etc.).
The User releases Liight from any liability arising from the delivery, collection, and enjoyment of rewards offered by third parties in the app, always ensuring the interests of the Users and taking appropriate measures regarding those Brands and Partners who fail to fulfill their obligations.
4. Access and Use
Access to the Application is limited to individuals over the age of 16. The User may not (i) authorize third parties to use their account or allow individuals under the age of 16 to access the Application through their account; nor (ii) allow individuals under the age of 16 to participate in challenges and receive or redeem rewards from third parties unless accompanied by the account holder and/or authorized by their parents or legal guardians. The User acknowledges and accepts that access to and use of the Application and/or Website occurs freely and consciously, under their sole responsibility. Liight will not be liable under any circumstances for the use that the User and/or third parties may make of the Application and/or Website, nor for any damages that may arise from it.
The User agrees to use the Application and/or Website appropriately and lawfully in accordance with applicable laws and these General Terms of Use. The User must refrain from (i) unauthorized or fraudulent use of the Application and/or Website; (ii) accessing or attempting to access restricted resources of the Application and/or Website; (iii) using the Application and/or Website for illegal or unlawful purposes, contrary to the provisions of these General Terms of Use, harmful to the rights and interests of third parties, or in any way that may damage, disable, overload, or prevent the normal use or enjoyment of the Application and/or Website; (iv) causing damage to the Application and/or Website or the systems of its providers or third parties; (v) introducing or spreading computer viruses or any other physical or logical systems that may cause damage to the systems of Liight, its providers, or third parties; (vi) attempting to access, use, and/or manipulate data from Liight, third-party providers, and other users; (vii) reproducing, copying, distributing, transforming, or modifying the Content, allowing access to third parties through any form of public communication, unless authorized by the holder of the corresponding rights or legally permitted; (viii) obtaining or attempting to obtain content using means or procedures other than those made available for this purpose, as appropriate.
The User may only access the Application and/or Website through authorized means. Liight will not be responsible if the User does not have a compatible device or has downloaded a version of the Application incompatible with their device.
5. Additional Conditions for Access and Use
Access to the Application is always subject to the prior registration of the User by completing the corresponding form ("Registration Form"), which will be provided to the User in advance. Liight reserves the right to freely accept or reject the User's registration request. The data entered by the User in the Registration Form must be accurate, current, and truthful at all times. Access and use of the Application or the specific area of the Website will be subject to a password assigned to the User upon completing the Registration Form, and access will be deemed made by the User, who will be responsible in any case for such access and use or by registering through their user on other tools and social networks such as Gmail or Facebook. The User will be responsible at all times for the custody of their password, assuming, consequently, any damages and losses that may arise from its misuse, as well as its assignment, disclosure, or loss. In case of forgetting the password or any other circumstance that poses a risk of access and/or use by unauthorized third parties, the User will immediately notify Liight so that it can immediately block and replace it. In any case, any operations carried out before such communication will be deemed carried out by the User, who will be responsible for and will pay the expenses and/or damages arising from any unauthorized access and/or use that occurs prior to such communication.
Access to the application with the "EcoSelfies" functionality will be subject to additional conditions for its use:
- We do not allow images that show explicit sexual activities, violent or humiliating content, as well as any material that includes minors. We will report any illegal content immediately.
- It is important that the images you share are related to real sustainable activities. When you upload images, you confirm that you have the rights to them and give us permission to review them. This is only to ensure that we promote sustainable actions genuinely. If any image does not comply with our policies, we reserve the right to remove it without prior notice.
- We reserve the right to partially or fully suspend your access to Liight if we believe there is a legal risk or a violation of our policies or terms. If we ever decide to delete your account for specific reasons, we may inform you and explain how you can request a review unless the violations are serious or repeated, or if that review could generate legal liabilities.
- If you ever feel that the suspension of your account was an error or unjustified, you can contact us at the following email address: hello@liight.es.
- When you use our platform and join our challenges, you give us permission to share the photos you share with us. We want to be able to showcase your creativity in various spaces such as the app itself, our social media, tracking reports, or other commercial-type dossiers. Remember that by uploading these images, you are granting us the right to use them. All images you share with us must follow the conditions mentioned above, so only share those images that you have no problem granting their use (such as a photo participating in a beach cleanup, cycling, or carrying out other sustainable actions).
6. Payment and Billing Conditions
Currently, through Liight, the user does not make any payments, but the inclusion of this functionality for the convenience of redeeming and receiving rewards is envisaged in the future. When this feature is implemented, the conditions will be updated, and the user will be duly informed. As a precautionary measure, the fees charged will not be refundable. The fees, their updates, and terms of use will be available at all times on the Application and/or Website and are subject to possible modifications. It is recommended that the User periodically access the Application and/or the Website to be aware of the applicable fees at each moment.
Liight reserves the right to modify, expand, reduce, establish, and/or eliminate any payment method at any time as it deems convenient for the proper functioning of the Service. The fees applicable to the Service will be charged to the User when redeeming rewards that involve this redemption method, using the credit card information provided by the User in the Registration Form.
In cases where Liight directly charges the credit card provided by the User, the startup reserves the right to validate the payment method. Likewise, each time the User requests a service, Liight reserves the right to request pre-authorization for payment according to the reward to the credit entity linked to the credit card provided by the User. In no case will this pre-authorization imply actual collection; the collection will only take place once the reward has been delivered.
Liight reserves the right to restrict the use and recover the amount of promotions, invitations, and discounts from Users who misuse, engage in unlawful activities, or abuse them. It is strictly prohibited for a User to create different Liight accounts or share an electronic payment method with other Users to unfairly benefit from discounts and invitations, which is considered an abusive use of them. Invitations and discounts will lose their value three months after creation. Additionally, Liight reserves the right to cancel or reduce the value of discounts, invitations, and promotions at any time. Finally, the value of invitations or discounts may be limited to certain reward categories.
In cases where Users pay with a credit card, and in accordance with the Privacy Policy, the credit card data provided in the Registration Form will be sent to the payment provider company responsible for storing such User data. The User may access or be redirected to the payment provider's website through the link provided in the Registration Form. In any case, it is recommended that the User review the terms and conditions of use and privacy policies of third-party websites accessed through links included in the Application and/or Website.
For security reasons, Liight has the authority to block, cancel, or invalidate any payment method when there are reasonable suspicions of misuse. Additionally, it is not allowed to use the same payment method on more than two independent accounts. If this happens, the company may proceed to block the Service to all accounts until the User provides documentary evidence of ownership of both accounts and the payment method entered.
In cases where Liight directly charges the User through their credit card, a summary of the action taken will be sent to the email address provided by the User, for purely informational purposes.
7. Intellectual and Industrial Property Rights
The User acknowledges and agrees that all intellectual and industrial property rights over the content and/or any other elements inserted in the Application and/or Website (including, without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, flowcharts, presentation, audio, and video) belong to Liight or, where applicable, third parties who have made them available through promotion agreements. Liight authorizes the User to use, view, print, download, and store the content and/or elements inserted in the Application and/or Website exclusively for personal, private, and non-profit use, refraining from performing any act of decompilation, reverse engineering, modification, disclosure, or supply on them. Any other use or exploitation of any content and/or other elements inserted in the Application and/or Website, different from what is expressly provided here, will be subject to the prior authorization of Liight.
8. Data Protection
The personal data (hereinafter, the "Data") that the User provides through the Registration Form will be integrated into a personal data file for which Liight is responsible. For more information, please refer to the Privacy Policy.
Basic Information on Data Protection Processing:
Controller: Light App S.L.
Purpose: Provision of the service.
Legal Basis: Consent of the data subject, obtained through the individual's free, unequivocal, express, and explicit agreement with our privacy policy.
Recipients: The data collected will be hosted on our AWS server in Paris. The provided information will not be disclosed to third parties unless required by law. However, certain personal data (nickname, email, and images) may be shared with third parties in specific cases, and user consent will be obtained beforehand. This consent will be transparently requested, and users will have control over the decision to share or withhold certain data with third parties.
Retention Period: Personal data provided through the registration form will be kept indefinitely until the user decides to delete their account or requests the removal of their data. We retain this data to continuously provide our services and enhance the user experience. However, users have the right to request the deletion of their personal data from our systems at any time.
Rights: You may exercise your rights of access, rectification, limitation of processing, deletion, portability, and objection to the processing of your personal data, as well as revoke any consents you may have given. 9. Disclaimer of Warranties and Liability
Liight does not guarantee the availability and continuity of the operation of the Application and/or Website. Accordingly, Liight will not be responsible in any case for any damages that may arise from (i) the lack of availability or accessibility to the Application and/or Website; (ii) interruptions in the operation of the Application and/or Website or computer failures, phone breakdowns, disconnections, delays, or blockages caused by deficiencies or overloads in phone lines, data centers, the Internet system, or other electronic systems, occurring during its operation; and (iii) other damages that may be caused by third parties through unauthorized intrusions beyond Liight's control.
Liight provides the User with various contact channels such as social media profiles or the email address hello@liight.es, where the User can communicate with Liight. Liight does not guarantee the absence of viruses or other elements in the Application and/or Website introduced by third parties unrelated to Liight that may cause alterations in the physical or logical systems of the User or in the electronic documents and files stored in their systems. Consequently, Liight will not be responsible in any case for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations in the physical or logical systems, electronic documents, or files of the User.
Liight adopts various protection measures to safeguard the Application and/or Website and its contents against third-party cyberattacks. However, Liight does not guarantee that unauthorized third parties cannot learn about the conditions, characteristics, and circumstances in which the User accesses the Application and/or Website. Therefore, Liight will not be responsible in any case for damages that may arise from such unauthorized access.
By subscribing to these General Terms of Use, the User declares that they will indemnify Liight against any claims against it, its parent company, directors, partners, employees, lawyers, and agents arising from the User's breach of any provision contained in these General Terms of Use or any law or regulation applicable to them, the breach or violation of the rights of third parties, any damage or harm caused by the User and/or their companions in the use of the Service to a third party, and the violation of the permitted use of the Application and/or Website.
Likewise, the User agrees, by subscribing to these General Terms of Use, to behave during the use of the application in accordance with morality, good customs, and public order. The User waives and releases Liight from any obligations, claims, or damages arising from the relationship with the third party. Liight will not be a party to any disputes between the User and the third-party carrier. All responsibility or obligation arising from the relationship between the User and the third party, whether through software or service provision, rests solely with the User, with all the implications that this entails. Therefore, the User understands that (i) by using the Application and/or Website and consequently the service.
10. Notifications
Liight may provide timely notifications through a general notification in the Application, via the email address provided by the User in the Registration Form, social media, through SMS, or by regular mail to the address/contact details provided by the User in the Registration Form. The User, in turn, may send notifications to Liight through the Help Center of the App.
11. Assignment
The User may not transfer their rights and obligations under these General Terms of Use without the prior written consent of Liight. Liight may transfer these General Terms of Use to any entity within its group of companies worldwide, or to any person or entity that succeeds it in the conduct of its business, without the need to obtain the User's prior consent. Also, and exclusively in anonymized form, Liight may share with third parties general usage data collected through the platform.
12. Applicable Law and Jurisdiction
These General Terms of Use, as well as the relationship between Liight and the User, will be governed and interpreted in accordance with Spanish law. Thus, Liight's activity is subject, among other applicable regulations, to Law 34/2002, of July 11, on services of the information society and electronic commerce, as well as Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users. The parties agree to submit to the exclusive jurisdiction of the courts and tribunals of Madrid for the resolution of any dispute regarding these General Terms of Use or the relationship between them.
13. Disclaimer of Apple Inc's Responsibility
This website and the software application have no affiliation with Apple Inc.
Legal Basis for Challenges and Raffles
FIRST. Purpose
With the aim of encouraging and motivating the use of the Liight App (hereinafter the "Service" or the "App"), accessible through registration in the app itself, the startup Liight, with headquarters and offices at Lanzadera Building, La Marina de Valencia, 46024 Valencia, currently legally represented under the Limited Company LIGHT APP S.L. with VAT ID B87864658, (hereinafter, the "Startup") periodically promotes giveaways (hereinafter, the "Giveaways") that will be governed by these legal bases (the "Legal Bases"). The specific characteristics of each giveaway, such as dates, prizes, points, among others, will be detailed in the corresponding profile for each giveaway published in the App. It is important to note that the brand "Apple Inc." is not responsible or a sponsor of this promotion. The startup and its promoters are available for any communication through the contact channels hello@liight.es and social media profiles. These are standardized bases for the giveaways conducted through Liight, all of which adhere to similar mechanics outlined in these bases.
SECOND. Duration of Each Challenge and Giveaway, Deadline
The Challenge/Giveaway will begin when it is displayed as active on the main screen of the App. The conclusion will be on the date and time indicated in its detailed profile. This date will be determined based on a minimum participation of users or based on a maximum number of issued tickets, or it will be specified in the giveaway's own profile. Liight reserves the right to modify, and may end the event, contest, or promotional activity early and/or extend it if it is reasonable or necessary.
THIRD. Territorial Scope of the Promotion
Challenges and giveaways are valid only for users physically located in the territory of the European Union. Depending on the user's location, they may carry out different available actions, participate in various activities, or take part in different promotions.
FOURTH. Nature of the Promotion
Participation in each challenge/giveaway is free, voluntary, and will be structured under the mechanics of a Challenge or Giveaway.
FIFTH. Participation Conditions
All individuals registered in the App who perform at least one operation of access, sharing, or participation in any of the available actions can participate in the Giveaway. Each App user has a certain amount of accumulated "Liights" points, and their participation in the giveaway can take place when they have the necessary points established for each giveaway or obtain this right through challenges presented on the platform or other available mechanics (Liight Bonus, social media actions, specific collaborations, events, etc.).
To register for the giveaway, it is necessary to do so with a real Liight user account. In the event that the participant has registered with false information, their participation will not be considered, and they will be excluded from the possibility of winning any prize. Only participation from real users will be valid. If irregularities or dishonest or questionable conduct are detected in the challenge mechanics, and it is conclusively verified, the entries may be eliminated.
Employees of the Startup are excluded from participating in this Giveaway. Users who do not provide their information to the Startup cannot participate in the Giveaway, as it is a necessary contractual requirement for the use of the App.
SIXTH. Participation Mechanics and Prize Acquisition
We distinguish between the two possible cases, based on the nature of the promotion:
Raffle
According to the guidelines set by the App's own regulations, users can obtain a maximum of [n] tickets in the giveaway by redeeming [x] Liights per ticket. Each ticket is entirely independent of another, even among the tickets of the same user, and constitutes one entry in the giveaway. ([n] and [x] are specified in the card related to the specific giveaway publicly available in the app).
The giveaway will be conducted openly through our social media and/or online using certified tools that confirm its validity. Any user wishing to delve deeper into the mechanics of the random contest can find specific information about each challenge in the "Rules." In the event that any of the Winners forfeit the Prize, cannot be located within the specified period, or does not meet the requirements established in these Legal Bases, the prize(s) will be declared void.
Challenge
Each challenge has a different theme, but all follow the same conditions. During the specified period in the challenge description, a ranking counts, with a counter set to zero for all users at the start of the challenge, the Liights (points in the app) of each user enrolled in the challenge. To understand the dynamics of a particular challenge, refer to the "Rules'' section.
SEVENTH. Prizes
In the profile of each giveaway, details, descriptions, and quantities of the Prizes (hereinafter, the "Prizes" or individually, the "Prize") will be indicated. The Prizes are subject to the following conditions:
- Prizes cannot be subject to change, alteration, or compensation at the request of the awarded participant.
- Awarded participants may decline the prizes obtained, but under no circumstances will an alternative prize, indemnification, or compensation be offered.
- The redemption of Prizes is subject to product stock and may be replaced, if necessary, by another Prize of equivalent value and/or characteristics. Under no circumstances can a winning user request the exchange of prizes for cash or have them sent to a person other than the winner.
Additionally, it is worth specifying that once the Liight award is delivered, Liight assumes no responsibility for its use, redemption, or validity. It is the sole responsibility of the user to redeem it, if applicable, during the established validity period. Liight is also not responsible for any damage, loss, or defect that may occur during shipping. In the case of receiving a product in poor condition, the user should contact the customer service of the reward provider directly to report the issue. Liight collaborates with various providers of sustainable fashion, local businesses, or other partners who sponsor the rewards and are responsible for their shipping, warranty, return management (if any), etc.
The allocation of shipping costs for the prizes will depend on the specific circumstances of each case. Liight reserves the right to determine whether it will fully or partially cover shipping costs, or if it will be the responsibility of the winning user to cover such costs.
Regarding collaborations with third parties (Brands and Partners), sponsored challenges, independent challenges, or other collaboration mechanics, the Startup will not be responsible for errors in the description of the characteristics of the products or services that are the subject of the Prize. Prizes will be subject to taxes and withholdings applicable under current legislation.
EIGHTH. Challenge/Raffle Mechanics and Prize Notification
In accordance with the guidelines set by the App's own regulations, for a fixed amount of "Liight" points specified accordingly, the account holder user can access participation in the chosen Giveaway, which will be held as described in the giveaway profile. In the profile of each promotion, whether it is a “Giveaway” or “Challenge”, details, descriptions, and quantities of the Prizes (hereinafter, the "Prizes" or individually, the "Prize") will be indicated. The giveaway will be conducted through social media and/or online using certified tools that confirm its validity. Any user wishing to understand these mechanics of the random contest more thoroughly can contact us through our communication channels, and we will show them the procedures used to verify its legitimacy. In the event that any of the Winners forfeit the Prize, cannot be located within the specified period, or does not meet the requirements established in these Legal Bases, the Prize(s) will be declared void.
NINTH. Prize Notification and Requirements for Delivery
Liight will announce the contest results at the end of the challenge through the app and/or on our social media. The winners will be mentioned, and Liight will contact the users via private message/email to manage the data and prize delivery. In challenges and initiatives carried out jointly with another entity (such as a brand, university, corporation, etc.), contact details may be provided to facilitate prize management between the winner/winners and the collaborating entity. These collaboration challenges or initiatives will be visible in Liight's content, and the name and logo of the collaborating entity may be placed on the cover, challenge description, or other spaces in the app to make the collaboration clear and evident. If the winner does not respond within 30 days from the notification, the startup reserves the right to either redraw the reward among the remaining participants or not, at its discretion. Within five (5) days following the Giveaway, the Startup will contact the Winners through push notifications and/or email to inform them of their winner status. If the winner cannot be contacted before the expiration date specified in the profile, they will automatically lose the right to obtain the Prize.
TENTH. Disclaimer and Modifications
In this giveaway, the Startup is released from any liability that may arise from any circumstances attributable or damages to third parties that may affect the development of the giveaway mechanics, especially the prize delivery.
In the event of force majeure beyond its control, the Startup reserves the right to make any changes, shorten, extend, or suspend the Challenge/Giveaway, committing to give these modifications the same degree of publicity as these Legal Bases, through their update on the App, website, and social media.
ELEVENTH. Claims
Any claims arising from this Giveaway must be submitted within three (3) months following the date of the Giveaway. Liight acts as the moderator of the challenge itself, with the collaborating brand assuming the prize amount (including taxes or withholdings, if any), its shipping/delivery, warranties, and other aspects related to the product. Liight acts as the "organizer" of the challenge/giveaway, but each promotion involves another explicitly involved agent, the collaborating brand, which provides the reward and is responsible for all aspects related to the prize.
TWELFTH. Privacy Policy
All voluntarily provided personal information will be incorporated into the Startup's file, and the processing of this information is authorized for the purpose of sending advertising and/or promotional communications via email about our products or services. Users have the right to access, rectify, cancel, and oppose this information. The file manager is the Startup itself. Detailed information on this point is available in our Privacy Policy section. You can exercise your rights of access, rectification, cancellation, opposition, portability, and limitation of data processing via email to dpd@liight.es, indicating the specific request.
THIRTEENTH. Authorization for the Use of Name and Assignment of Image Rights
Participants authorize the publication of their nickname on the Startup's website and social media platforms (participation in rankings and announcement of winners/hall of fame), as well as on any of its official communication channels, without generating any right to receive compensation. The winner will be asked for their name (nickname used within our app) to publicly announce the winner. Likewise, they will be contacted to voluntarily provide a photo when they receive the corresponding reward, in order to share it on our social media (all of which will be properly specified to the user before making the decision).
To promote sustainable actions, Liight has a feature called "EcoSelfies" through which users can take pictures of various activities such as participating in beach cleanups, reforestation actions, creating sustainable recipes, or other environmentally responsible gestures. All images shared with us must adhere to our terms of use (+info in Terms and Conditions), and you are granting us the right to commercially use and/or publish your images on social media.
FOURTEENTH. Acceptance of the Legal Bases
Participation in the Giveaway implies the full acceptance of these Legal Bases, as well as acceptance of the Startup's criteria in interpreting them. Any attempt to deliberately harm the content or operation of this promotion is illegal and will be subject to legal action by Liight. The expression of non-acceptance of these bases will imply the exclusion of the participant, and as a consequence, Liight will be released from fulfilling the obligation contracted with that participant.
FIFTEENTH. Rights
Liight reserves the right to prevent the establishment of speculative or business systems related to this promotion, in which case legal actions deemed appropriate may be taken. It also reserves the right to modify or suspend this promotion, if there is justified cause, committing to communicate with sufficient advance notice, the new bases, conditions, or, if necessary, the definitive cancellation. The use of the name and image of the collaborating brand/partner, with whom Liight has no right or relationship, is used to provide them with visibility with an "advertising" intention and without damaging their brand image in any case. In the remote situation where the brand itself could be affected by this promotion or if requested, the images and publications made would be removed.
SIXTEENTH. Applicable Law and Jurisdiction
This promotion will be governed by the current common Spanish law. For any dispute arising from the interpretation and application of these Legal Bases, both the Startup, the Adhered Entities, and the participants in this Giveaway expressly submit to the jurisdiction of the Courts and Tribunals of Madrid, without prejudice to the jurisdiction that may correspond to the consumer by law.

When we ask you to fill in personal information fields that may identify you, we do so ensuring that it will only be used in accordance with the terms of this document. However, this Privacy Policy may change over time or be updated, so we recommend and emphasize continuously reviewing this page to ensure that you agree to any changes. As established in the General Data Protection Regulation, the data controller is the legal entity LIGHT APP S.L.
To be a registered user of the Liight social platform and access its services, it is necessary to know this Privacy and Data Protection Policy (hereinafter, "Privacy Policy") and give consent through the checkbox in the corresponding registration form, authorizing the User's data processing.
Liight's Privacy Policy affects both the personal information provided at the time of profile creation and the data provided when accessing various offered services for as long as the user account remains active.
In accordance with the provisions of the General Data Protection Regulation (GDPR), Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, we inform you that this Privacy Policy and the data protection clauses that may appear throughout this website will serve Liight to comply with the current regulations on the protection of personal data at all times.
Users, by checking the box, expressly and freely and unequivocally agree that their personal data be processed by Liight for the following purposes:
1. Identifying users, including (but not limited to) nickname and email, on the platform and thus giving them access to the services, features, and applications that Liight makes available.
2. Sending information from Liight, both through the social platform itself and other means. Such communications may cover changes and updates related to Liight as well as activities, products, services, offers, special promotions, etc., corresponding to related sectors (mainly information about new sponsored challenges available on the social platform). This information may be segmented based on the provided information (age, location, gender, among others), with the aim of providing personalized service and relevant information.
The user can exercise their rights of access, rectification, modification of their personal data, and opposition to the processing of the same for one or more of the above purposes at any time by contacting Liight through the email dpd@liight.es.
Liight prepares periodic reports for which it collects user activity data, quiz responses, and other relevant data. These reports and/or results may be published or shared with third parties (e.g., the challenge sponsor), but it will always be in a completely anonymized and aggregated manner, meaning that user activity data that allows identification will never be shared. They will be part of an aggregated report, making it impossible to reverse the process to identify a particular user.
Liight has adopted all necessary technical and organizational measures to ensure the security and integrity of the personal data it processes, as well as to prevent its loss, alteration, and/or unauthorized access by third parties. Likewise, the Liight social platform uses generally accepted information security techniques in the industry, such as firewalls, access control procedures, and cryptographic mechanisms, all with the aim of preventing unauthorized access to data. To achieve these purposes, the user agrees that the provider obtains data for the purpose of the corresponding authentication of access controls.
Permissions
Our application will require a set of permissions for the proper development of the offered service:
- Internet: This permission is necessary to synchronize with the central database, validate sustainable activities, and perform the majority of central services in the application.
- Location: This is essential for the proper functioning of the validation of sustainable activities. Without it, it is not possible to validate activities, and therefore, the rest of the tool would be meaningless. The application may also collect imprecise background information about the user's location, as long as it has not been closed, with the aim of segmenting the user and creating a more tailored profile. This allows us to segment challenges and rewards more effectively.
- Camera: This permission is not mandatory for the proper functioning of the application; it will be requested to scan QR codes on containers or sustainable areas and/or to perform the EcoSelfies activity (sharing photos while engaging in sustainable actions). Users can always deny this permission, which will restrict them from scanning QR codes, uploading EcoSelfies, and earning corresponding rewards.
- Activity Recognition: This permission is not mandatory for the proper functioning of the application. Its purpose is to provide additional information about the validity of sustainable activities performed by the user. In case of doubt about possible user fraud, the data collected through this permission will help in deciding on the possibility of fraud. For more information about the data collected through this permission, please refer to the section "Type of Collected Information."
These permissions can generally be managed from the application settings screen, in system settings (both on Android and iOS).
Type of Collected Information
Our application and/or website may collect personal information, such as name, contact information like email address, location, and sociodemographic information. Additionally, through the use of the application, data related to the user's profile, including interests, habits, etc., may be inferred. This information is utilized for the operation of the application, specifically for traceability and validation of sustainable actions (calculation of reduced CO2eq footprint), gamification mechanics, and user profiling to provide the best user experience within the platform.
Furthermore, when necessary, specific information may be required to process an order or facilitate delivery and billing. The provided personal data will be retained as long as the user maintains a relationship with the application and has not requested the deletion of information. This information is stored on our platform, hosted on cloud servers contracted from Amazon Web Services (AWS) in Europe.
Liight's application may also collect, with the user's confirmed permission, information about the device's location.
Use of the Collected Information
Our application and/or website use the information to provide the best possible service, particularly for maintaining user records, processing orders when applicable, and enhancing our products and services. Periodically, emails may be sent through our site with special offers, new products, and other advertising information that we believe is relevant to you or may provide some benefit. These emails will be sent to the address you provide and can be unsubscribed at any time upon user request by sending an email to dpd@liight.es, specifying the specific request. The sending of these promotions will be exclusively based on the consent granted through the checkbox during the registration and onboarding process of the application.
Liight is highly committed to fulfilling the commitment to keeping your information secure. We use the most advanced systems and constantly update them to ensure there is no unauthorized access.
In the app, information about the points (exp) of other users, as well as the username (nickname) chosen by the user during registration or other information the user makes public in their profile (profile picture, level, badges, etc.), may be displayed. Additionally, for employees of a Corporate client, this nickname may also be visible in a ranking from communication screens within the company's offices.

A cookie refers to a file that is sent with the purpose of requesting permission to be stored on your computer. By accepting this file, it is created, and the cookie is then used to gather information regarding web traffic. It also facilitates future visits to a recurrent website. Access and Use
Access to the application is limited to individuals aged 16 and older. Users may not authorize third parties to use their account, nor allow individuals under the age of 16 to access the application through their account. The user acknowledges and agrees that access and use of the application and/or website occur freely and consciously, under their sole responsibility.
Liight will not be responsible in any case for the use that the user and/or third parties may make of the application and/or website, nor for any damages that may result from it.
Due to the content published by Liight, as well as out of respect for the privacy of participating users, almost all navigation on the platform must be carried out under the condition of being a registered user.
Some content on Liight does not require user registration. However, to enjoy all content, participate in challenges, and be eligible for prizes, the user must register for the service.
Access to the platform is free and open through registration via a form provided on the platform. The user must provide personal data voluntarily, committing to provide Liight with accurate, truthful, and complete registration information, including name, age, email address, and password, which will be used for accessing the service.
It is expressly prohibited for a user to register on Liight more than once (i.e., for the same individual to have multiple accounts or profiles on the platform). In the event of detecting duplicate profiles, Liight reserves the right to cancel the account(s) it considers duplicated.
The user will select a username and password, committing to use them diligently and not make them available to third parties. The user assumes responsibility for the consequences that may arise from the disclosure of their login details to third parties. In case the user suspects that their account is being used by another user, they must proceed to change their password through the method specified on the website. If not possible, they should promptly inform Liight so that it can proceed with immediate blocking. This can be done through the email address dpd@liight.es.
The email provided by the user may be used by Liight to send notifications and news related to the user's followers on the platform, new features, updates on challenges in which they are participating, and any information that Liight deems important to convey, as well as activity related to the user.
Location Management
Our application and/or website use and retain traffic and location data generated in the provision of services to users. Location services utilize a combination of GPS, Bluetooth, Wi-Fi access points, and cell towers to determine user location. The data collected through location services via the use of the application is used in the operation of the application for traceability and validation of sustainable actions (calculation of reduced CO2eq footprint).
Location services are not activated by default, and you must enable them if you wish to use them. If you activate them, you can change your mind and deactivate them at any time. To cancel this service, you have the option to send an email to the address: dpd@liight.es, specifying the specific request.
User Rights
The user of the application and/or website can exercise the following rights:

Automated Processes
Our application and/or website may use automated processes to process user data. This involves using data to evaluate certain aspects related to the person, aiming to predict their behavior and make decisions accordingly. In the context of email marketing or the app platform, this may involve segmenting the list to send a specific email campaign to a particular group, such as promoting various challenges or rewards directly tailored to their profile.

Automatic Activity Data
At Liight, we've observed that many users often forget to open the application when engaging in an activity, leading to frustration for not earning the corresponding rewards.
With this in mind, we have sought a way for users to earn points entirely passively, without even having to take their phone out of their pocket. This involves syncing with Google Fit for Android users and Apple Health for iPhone users.
Upon entering the application, users are asked if they want to activate synchronization and allow Liight access to these data.
In the specific context of Android and synchronization with Google Fit, we request access to the Activity and Location scopes. The Activity scope is necessary to determine the user's current activity: whether it's walking or biking. In the case of walking activity, we require the total step count to allocate points based on quantity and calculate the equivalent reduced CO2 footprint. Regarding biking activity, we need to know the cadence to adjust point allocation, and once again calculate the amount of equivalent reduced CO2. These scopes enable us to access crucial information to enhance the user experience and ensure consistency with Liight's mission of promoting sustainable habits.
On the other hand, access to the Location scope provides us with information about the distance traveled by the user during a specific activity. This information is essential for better understanding the activities performed and providing accurate feedback to the user.
It's important to note that all data collected from Google Fit is processed on the user's mobile device and then sent to the server for validation. Once validated, this data is stored in our database in Paris, hosted on AWS, exclusively for the purpose of providing an enhanced service to the user. This data can be accessed by the user in the 'Activity History' section of the application.
The database in question is hosted on Amazon Web Services servers in Paris, France, with appropriate security measures in place to prevent any form of hacking.
